An Offer in Compromise allows you to settle your tax debt for less than the full amount you owe if you can prove that paying in full would create financial hardship. It's part of the IRS Fresh Start expansion but remains a standalone resolution program. A full financial disclosure (Form 433-A/OIC) is required for consideration.
An Installment Agreement is a monthly payment plan for taxpayers who can’t pay their entire tax bill at once. The IRS offers different types, including streamlined and guaranteed plans, depending on how much you owe and how quickly you can repay.
A Partial Payment Installment Agreement allows you to pay less than the full amount over time based on your ability to pay. The IRS collects what it can before the collection deadline expires. This plan requires financial review and may be reevaluated periodically.
If you're in financial hardship, the IRS can place your account in Currently Not Collectible status. This pauses all collection activity—no levies, garnishments, or seizures. However, the debt remains active, and interest continues to accrue. The IRS may review your financial situation later.
Penalty Abatement is a way to have IRS penalties reduced or removed. This does not apply to the base tax amount. You may qualify for abatement if you have a valid reason for falling behind (e.g., illness, disaster) or if it’s your first time being noncompliant.
Innocent Spouse Relief protects you from being held responsible for a spouse’s or ex-spouse’s tax errors. Relief is available if you had no knowledge of the problem and didn’t benefit from it. The IRS offers several versions, including traditional relief, separation of liability, and equitable relief.
The IRS has 10 years from the date a tax is assessed to collect the debt. After that, the balance is legally uncollectible. If you're nearing that 10-year mark, you may benefit from a strategy that delays or minimizes collection activity until the statute expires.
In limited cases, certain income tax debts can be discharged through Chapter 7 or Chapter 13 bankruptcy. This depends on factors like how old the debt is, whether returns were filed on time, and the type of tax owed. Bankruptcy is a legal process, not an IRS program, but it can eliminate tax debt under strict conditions.
The Collection Appeals Program (CAP) and Collection Due Process (CDP) hearings allow you to formally challenge IRS actions such as liens, levies, or asset seizures. A CDP hearing can temporarily stop collection while your case is reviewed, giving you a chance to propose an alternative solution or dispute the action.
